TERMS AND CONDITIONS

1. Copyright and Usage License

Ownership: The photographer retains copyright of all images, according to JOHN KERR FOTO.

Licensing: Clients (usually agents) are granted a license to use photos for marketing the property listing only.

Transferability: The license is non-transferable; it cannot be sold or given to stagers, builders, or future agents without prior permission. 

2. Property Preparation & Liability

Preparation: The property should be staged and cleaned before the photographer arrives.

Liability: Photographers generally are not responsible for moving heavy furniture or items.

Safety: The photographer may refuse to photograph unsafe or unclean environments. 

3. Cancellation & Rescheduling

Notice Period: A minimum of 24 hours' notice is typically required to cancel or reschedule. 

Fees: A Late cancellation fees may result if insufficient notice has been provided or if Access at the property has been hampered

Outdoor shoots may be rescheduled due to bad weather at no cost. 

4. Payment and Delivery

Payment: Payment is required 10 days after invoice recieved.

Turnaround: Standard delivery is within 24–48 hours.

Editing: Basic editing is included; heavy retouching (e.g., removing power lines, virtual staging) is charged extra. 

5. Liability & Indemnification

Limitation of Liability: The photographer's liability is generally limited to the fees paid for the shoot.

Indemnification: The client agrees to hold the photographer harmless from claims arising from the shoot, such as property damage. 

6. Additional Terms

Right to Refuse: The photographer reserves the right to refuse providing any future photography services if the property is not ready, in an unsafe condition or if payment for previous work are outstanding. 

CHARGES 

£35 Will be charged for wasted journeys. 

£35 Will be charged for missed or rescheduled appointments with less than 12 hours notice. 

£20 Will charged for travel costs outside 30miles. 

The Actual fare will be charged for trips involving air or ferry. 

£0 wil be charged for restoring lost customer files. 

£0 charged for parking fees. 

£0 will be charged for shoots outside of business hours. 

£0 will be charged for re-shoots where agreed content has been missed by the photographer.
